Aiberry, Inc. ("Aiberry," "we," or"us") is committed to protecting privacy. This Privacy Policy explains the limited information practices applicable to the Digital MindCareproduct and related screening forms (collectively, "DigitalMindCare"). Digital MindCare is an anonymous, login-free mental health screening tool that institutions—such as colleges and universities, community mental health organizations, and employers (each, a "SponsoringOrganization")—make available to the individuals they serve.

Aiberry maintains three separate privacy policies because its products handle information differently:
This is the Digital MindCare Privacy Policy. If you accessedDigital MindCare through a website, portal, or application operated by aSponsoring Organization or other third party, that party's own privacy practices also apply to your use of its systems.
BY USING OR OTHERWISE ACCESSING DIGITAL MINDCARE, YOU ACKNOWLEDGE THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY. YOU ARE NOTREQUIRED TO PROVIDE ANY INFORMATION THAT IDENTIFIES YOU IN ORDER TO USE DIGITALMINDCARE.
This Privacy Policy is effective as of June 28, 2026.This Privacy Policy may be revised or updated by Aiberry from time to time in its sole discretion. Where appropriate, Aiberry will provide notice to you as provided in the Terms of Use. By continuing to access or use Digital MindCareafter the effective date of any such change, you agree to be bound by the modified Privacy Policy.
Digital MindCare is designed with privacy in mind and does not collect, store, or associate any personally identifiable information (PII)or protected health information (PHI) with the form responses. The data submitted through these digital forms is collected anonymously and is not linked to any user profile or identity. We do not indefinitely retain form responses in our systems, and the content submitted is not used for any profiling, advertising, or behavioral tracking.
Analytics and Error Monitoring. While we do not collect or store any form data indefinitely, we may collect limited technical information to improve the functionality and reliability of our service. This includes IPaddresses, which may be captured by third-party services for error monitoring and for usage analytics. These tools help us understand system performance and user interaction at an aggregate level but are not connected to the form content or any user identifiers. All usage is governed by the respective privacy policies and data handling practices of these third-party services. We ensure that no form submission data is ever sent to or stored within these tools.
We use the limited information involved in Digital MindCareonly to: operate, maintain, and secure the service; diagnose or fix technology problems; monitor system performance and usage at an aggregate level; and generate aggregate, de-identified results for the applicable SponsoringOrganization as described in Section 5. The content submitted through DigitalMindCare is not used for any profiling, advertising, or behavioral tracking,and we do not sell information collected through Digital MindCare.
We are not in the business of selling information about our users to third parties without your consent. The limited parties with whom information may be shared are:
Our Contractors. We may either employ or contract with third-party companies for the purposes of operating our service, enhancing our service, or fulfilling your requests (such as hosting platforms, anti-fraudfunctions, error monitoring, or analytics). In order for these third-party companies to carry out their services, the limited technical information described in Section 2 may be shared with these third-party companies, but our contracts with these third parties prohibit them from using any of that information for purposes unrelated to the services they are providing to us.
Using and Sharing Anonymized Data. We may de-identify and anonymize information so it is no longer associated with any individual(s) in order to use it for other purposes, such as aggregating the data for statistical analysis and providing aggregate, population-level results to the applicable Sponsoring Organization. Such reports do not identify any responding/individual.
Government, Courts, and Law Enforcement. We may access,preserve, and share information about you, without consent, to government or law enforcement officials or private parties as we in good faith believe necessary or appropriate to respond to claims and legal process (including, but not limited to, subpoenas), to comply with applicable laws, to protect the property and rights of Aiberry, you, or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to pose a risk of being, or is, illegal, unethical, or legally actionable. BecauseDigital MindCare responses are anonymous and not associated with any identity,there is ordinarily no identifiable individual record for Aiberry to disclose in response to such requests.
Responses submitted through Digital MindCare are not used to train, fine-tune, develop, or otherwise improve any artificial intelligence or machine learning model. The anonymous data submitted through Digital MindCareis used to deliver the screening and to produce the aggregate results described in Section 5, and not as training data.
We do not indefinitely retain form responses in our systems.Form responses are retained only to the extent necessary to deliver the service and to produce the aggregate results described in Section 5, after which they are deleted or further de-identified. Limited technical information held by our error-monitoring and analytics providers is retained in accordance with those providers' own practices.
A "cookie" is a small string of data which often includes an anonymous unique identifier sent to your browser from a website's computers, and stored on your computer's hard drive. These cookies and other similar technologies like pixels, web beacons (also known as "clearGIFs"), and local storage may be used to collect information about how you use Digital MindCare and provide features to you.
You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set. (Each browser is different, so check the "Help" menu of your browser to learn how to change your cookie preferences.) However, if you reject all cookies, you may not be able to use some features of Digital MindCare. In connection with Digital MindCare,these technologies are used only to operate the screening experience and to support the aggregate analytics and error monitoring described in Section 2;they are not used to track you over time and across third-party websites or to deliver targeted advertising.
Certain other Aiberry products, including Smart MindCare,may involve PHI under the Health Insurance Portability and Accountability Act("HIPAA"). Digital MindCare is different. Because Digital MindCarecollects responses on an anonymous basis with no identifiers, it does not collect or create PHI, and Aiberry does not act as a HIPAA covered entity or business associate in connection with Digital MindCare.
By using Digital MindCare, you consent to the transfer of the information involved to anywhere where we or our contractors maintain facilities for the use of that information as described in this Privacy Policy.Although we implement reasonable administrative, physical, and electronic security measures designed to protect the information involved from unauthorized access, we cannot ensure the security of any information you transmit to us or guarantee that this information will not be accessed,disclosed, altered, or destroyed. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of information we hold. To the extent the law of your jurisdiction allows for notification of a breach via e-mail or conspicuous posting through Digital MindCare, you agree to accept notice in that form.
We have developed data practices designed to ensure information is appropriately protected, but we cannot always know where information may be accessed or processed. While Digital MindCare is maintained and operated within the United States, we may transfer information outside of the United States if necessary. As described in this Privacy Policy, we may employ contractors to perform functions on our behalf, and if information is accessible to a third party or to our employees outside of the United States, we will seek assurances that such information is safeguarded adequately, in accordance with this Privacy Policy and applicable laws.
Digital MindCare is hosted in the cloud based in the UnitedStates. If you are accessing the service from the European Union or other regions with laws such as GDPR governing data collection and use, please note that information may be transferred to and processed in the United States in accordance with this Privacy Policy.
We do not track our users over time and across third-party websites to provide targeted advertising. We do not respond to Do Not Track("DNT") signals and handle all information consistent with thisPrivacy Policy.
Digital MindCare may be embedded within, or contain links to, other websites or services that we do not own or operate, including those operated by a Sponsoring Organization. We are not responsible for the practices employed by such websites or services, including the information or content contained within them. Your use of any third-party website or service is subject to that third party's own rules and policies, not ours.
We may share information with companies under common control(such as a parent company or subsidiary) to be used in a manner consistent with this Privacy Policy. If part or all of Aiberry or our assets is transferred to another organization, information associated with Digital MindCare may be among the items transferred. The recipient will have to honor the commitments we have made in this Privacy Policy.
